FY 2013 H-1B Cap Likely to Be Reached in June

As of May 11, 2012, U.S. Citizenship and Immigration Services (USCIS) has received a total of approximately 51,500 H-1B cap filings for employment in FY 2013: 36,700 petitions have been receipted against the “regular cap” of 65,000 and 14,800 H-1B petitions have been receipted against the “Master’s cap” of 20,000 for foreign nationals with advanced degrees from U.S. universities and colleges.

Flurry of Visa Fraud-Related Lawsuits Filed Against Indian IT Firms

Immigration status and working conditions are the focus of lawsuits against three of India’s largest IT outsourcing firms, Infosys Technologies, Larsen & Toubro InfoTech, and Tata Consultancy Services. Current and former employees allege that the firms engaged in visa fraud/misuse and harassment. These allegations have far-reaching implications as they attract increased government scrutiny.

A brief summary of each of these lawsuits follows.

Legislation Introduced to Qualify Israeli Investors for E-2 Visas

On March 19, 2012, the House of Representatives passed H.R. 3992 by a 371-0 vote, which would add Israel to the list of countries whose nationals are eligible to receive E-2 nonimmigrant visas as investors. The measure is contingent on Israel providing reciprocal nonimmigrant status to U.S. nationals in Israel. On May 9, 2011, a companion bill (S. 921) was introduced in the Senate, but the Senate Judiciary Committee has yet to consider the bill.

On March 27, 2012, the U.S. Citizenship and Immigration Services (USCIS) published a draft of proposed revisions to Form I-9, Employment Eligibility Verification, the form that must be completed by all employers to verify the employment eligibility of every new hire.

Revised Department of State Visa Processing Fees Effective April 13

Effective April 13, 2012, visa processing fees at U.S. consular posts for several types of nonimmigrant and immigrant visa applications have changed. The fees for most nonimmigrant visa applications have increased, while those for all immigrant visa applications and “Treaty Investor” and “Treaty Trader” (E) nonimmigrant visa applications have decreased.

U.S. Department of State Confirms that FY 2012 Annual Limit for China and India EB-2 Category Has Been Reached

As we reported in the March 2012 issue of the Immigration eAuthority, the U.S. Department of State (DOS) announced that, effective March 23, 2012, no further EB-2 category immigrant visas will be authorized for China-mainland born and India applicants with priority dates later than August 15, 2007.

BALCA Decision Clarifies Recordkeeping Requirements for PERM Labor Certification Applications

Under the PERM regulations, employers filing for permanent labor certification must maintain specified supporting recruitment documentation after filing the application and present it to the U.S. Department of Labor (DOL) upon request. In Matter of A Cut Above Ceramic Tile, the employer was unable to obtain a copy of the State Workforce Agency (SWA) job order from the state since the SWA’s database had been purged in the three-year span of time between publication and the DOL audit request.
